This Privacy Policy explains how FIH Partners processes your personal information. This Privacy Policy applies to personal data relating to FIH Partners’ client engagements, general marketing and recruitment. The privacy policy applies to clients, service providers, applicants and other parties about whom FIH Partners collects personal data.

2 DESCRIPTION OF THE PROCESSING

PURPOSE:
Purpose #1: Provision of FIH Partners’ services
In connection with FIH Partners’ advisory services personal information may be processed as part of FIH Partners’ engagement by clients, to enforce money laundering legislation and/or as part of documentation surrounding sale and purchase agreements.

 

Categories of personal data
We process the following categories of personal data about you:

Ordinary personal data:

  • Name, address, email and phone number
  • Date of birth and social security number
  • Passport, driver’s li-cense and health insurance certificate
  • Employment history, educational background and other CV details
  • Salary and compensation details
  • Performance evaluations

We collect your personal data from the following source(s):

  • Directly from you
  • Your employer (FIH Partners’ client)
  • Third parties involved in transactions
  • Counterparties

 

Legal basis for the processing
We process your personal data on the following legal bases:

  • Article 6.1.a (consent)
  • Article 6.1.b (necessary for the performance of the engagement agreement between you and/or your employer and FIH Partners)
  • Article 6.1.c (necessary to comply with legal obligations such as the Money Laundering Act)
  • Article 6.1.f (in FIH Partners’ legitimate interest when e.g. procuring the exchange of information between buyers and sellers of companies)

 

Recipients
We share your personal data with:

  • Parties involved in transactions (e.g. clients, counterparties, debt providers and other transaction advisors). Exchange of information is subject to confidentiality agreements unless information is publicly available, and sanctioned by FIH Partners’ clients or counterparties
  • FIH Partners’ service providers such as providers of IT and technical support services
  • Group entities

 

Data retention
We will store personal data as long as it is necessary in order to fulfil the mentioned purposes.

  • As part of engagement agreements, personal data will be stored for up to 5 years from the closing date of a transaction or from the date when an engagement is terminated
  • For regulatory obligations, as long as the law requires e.g. 5 years for identity information and identification documents pursuant to the Danish Money Laundering Act

 

Purpose #2: General marketing purposes

  • General marketing of FIH Partners’ services to prospective clients
  • Optimization of the user experience on FIH Partners’ website
  • User statistics from FIH Partners’ website

We process the following categories of personal data about you:

Ordinary personal data:

  • Name, address, email and phone number
  • User behavior and preferences on FIH Partners’ website

We collect your personal data from the following source(s):

  • Directly from you
  • Publicly available sources
  • FIH Partners’ website and other online sources such as social media
  • Public authorities

  • Article 6.1.a (consent) for the use of cookies
  • Article 6.1.f (In FIH Partners legitimate interest to maintain and develop FIH Partners client network and network of prospective counterparties, and to market FIH Partners services to the aforementioned parties)

We share your personal data with:

  • Group entities
  • FIH Partners’ service providers such as providers of IT and technical support services

We will store personal data as long as it is necessary in order to fulfil the purposes mentioned.

Information will be stored for as long as it is necessary for the ongoing client relationships, which will normally stretch over several years. Information will be stored up to five years after e.g.an individual is no longer employed with the client or potential client.

 

Purpose #3: Recruitment

Marketing of FIH Partners to prospective employees and in the evaluation of candidates.

We process the following categories of personal data about you:

Ordinary personal data:

Personal details and contact information such as name, address, email address, telephone number, date of birth, gender, picture, CPR-number or other identification numbers.

Personal qualifications and other details contained in applications and CVs such as educational background and other training, previous employment, references and other professional qualifications.

Evaluations and results of personality and assessment tests made by FIH Partners and/or third-party recruitment consultants.

We collect your personal data from the following source(s):

  • Directly from you
  • Service providers such as recruitment consultants
  • Third parties such as previous employers or other references
  • Publicly available sources

We process your personal data on the following legal bases:

  • Article 6.1.a (consent)
  • Article 6.1.f (In FIH Partners legitimate interest to employ the right candidates)

We share your personal data with:

  • FIH Partners’ service providers such as providers of recruitment, IT and technical support services
  • Group entities
  • Public authorities

We will store personal data as long as it is necessary in order to fulfil the purposes mentioned.

Information on rejected candidates is stored for 6 months unless the candidate consents to an extended retention period of 12 months.

Purpose #4: Transfers to countries outside the EU/EEA

In some cases, we will transfer personal data to the following countries outside the EU/EEA: USA (New York)

Such transfers will take place on the basis of the following legal basis:

– The country has not been deemed by the Commission of the European Union to have an adequate level of protection of personal data. We will provide appropriate safeguards for the transfer through the use of “Model Contracts for the Transfer of Personal Data to Third Countries”, as published by the Commission of the European Union, or any other contractual agreement approved by the competent authority. 3 YOUR RIGHTS

You have the following rights:

  • You have the right to request access to, rectification or erasure of your personal data.
  • You also have the right to have the processing of your personal data restricted.
  • If processing of your personal information is based on your consent, you have the right to withdraw your consent at any time. Your withdrawal will not affect the lawfulness of the processing carried out before you withdrew your consent. You may withdraw your consent at any time by sending an email to fihpartners@fihpartners.com.
  • You have the right to receive your personal information in a structured, commonly used and machine-readable format (data portability).
  • You may always lodge a complaint with a data protection supervisory authority, e.g. The Danish Data Protection Agency.

Furthermore, you have the right to object to processing of your personal data as follows.

  • If processing of your personal data is based on article 6(1)(e) or article 6(1)(f), see above regarding legal bases, you have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data.
  • Where your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data about you for such marketing.
